This is a first draft based on LiFit's current technical implementation. Dates and policy decisions explicitly identified as unfinished must be finalized before production use.

Acceptance of these Terms

These Terms of Service ("Terms") are an agreement between you and LiFit LLC ("LiFit," "we," "us," or "our"). By creating an account, accessing, or using LiFit, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service.

The LiFit service includes the mobile app, website, and related features that link to these Terms. Additional terms presented for a specific feature will also apply to that feature.

Eligibility

You must be at least 15 years old to use LiFit, must be able to legally enter into this agreement, and must not be prohibited from using the service under applicable law. People under 15 may not create an account or use the service.

If the law where you live requires a parent or guardian to consent to your use, that person must review and agree to these Terms on your behalf.

You must provide an accurate birth date. LiFit blocks birth dates showing that a person is under 15 from completing signup. If LiFit reasonably determines that an account bypassed or used false information to evade this age requirement, LiFit will disable and delete that account and its associated information, subject to applicable law.

Accounts and account security

You must provide accurate information and keep it reasonably current. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Do not share authentication codes or allow another person to use your account in a way that violates these Terms.

LiFit currently supports authentication through Firebase using email and password, Google, Apple, and phone flows. Your relationship with an external sign-in provider is governed by that provider's terms. Tell us promptly at the support address below if you believe your account has been compromised.

Profiles and privacy settings

You may create a profile with a username, display name, biography, photo, gym, fitness information, and visibility choices. Choose information you are comfortable sharing. Public profiles and content may be viewed by other users, and followers may receive additional access to private profiles through the current interface.

Privacy settings are not a promise that information can never be accessed or disclosed. You are responsible for reviewing settings and the content you choose to post. LiFit is responsible for maintaining appropriate technical access controls. Public share links and approved public partner or gym profiles may be viewed outside the app, including by people without an account.

Workout, nutrition, and progress features

LiFit lets you record workouts, exercises, sets, repetitions, weight, duration, meals, foods, nutrition totals, hydration, bodyweight, measurements, goals, workout plans, weekly or date-specific routines, nutrition targets, notes, and related activity. You are responsible for the accuracy of information you enter and for deciding whether a workout, food, target, or estimate is appropriate for you.

Statistics, achievements, personal records, calories, body-composition estimates, trends, reminders, and recommendations are generated from available data and simplified calculations. They may be incomplete, delayed, or inaccurate and should not be treated as professional advice.

No medical advice

LiFit is a fitness technology service, not a doctor, dietitian, healthcare provider, emergency service, or medical device. The service does not diagnose, treat, cure, prevent, or monitor any disease or medical condition and does not create a clinician-patient relationship.

Consult an appropriate physician, registered dietitian, coach, or other qualified professional before beginning or changing an exercise, nutrition, supplementation, or weight-management program, particularly if you have a medical condition, injury, are pregnant, take medication, or have concerns about your health.

Assumption of fitness-related risk

Exercise and changes to diet can involve risks, including overexertion, dehydration, allergic reaction, illness, property damage, serious injury, and death. You choose whether and how to perform an activity and are responsible for using proper technique, equipment, supervision, surroundings, and judgment.

Stop an activity and seek appropriate help if you experience pain, dizziness, faintness, shortness of breath, or other concerning symptoms. Do not rely on LiFit to identify unsafe conditions or determine whether you are physically able to participate.

Emergencies

LiFit is not an emergency monitoring or response service. Do not use the app to request urgent medical, safety, or law-enforcement assistance. If you may be experiencing an emergency, contact local emergency services immediately.

User content

LiFit allows users to submit profile information, posts, captions, photos, videos, workout and nutrition summaries, comments, gym activity, reports, and other material (collectively, “User Content”). You retain ownership of rights you hold in your User Content.

You represent that you have the rights and permissions needed to submit your User Content and that doing so does not violate law, these Terms, privacy, publicity, intellectual-property, contractual, or other rights. Do not post another person's sensitive information without permission.

License for hosted content

You grant LiFit a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process your User Content only as reasonably needed to operate, provide, secure, moderate, support, and improve the service and to make content available to the audience you select. This license includes allowing infrastructure providers to process content for those purposes.

The license ends when the content is deleted from LiFit's active systems, except to the extent a copy is maintained independently by an infrastructure provider under its operational terms, was shared with another user who retained it outside LiFit, or must remain because applicable law prevents immediate deletion. LiFit's supported post and account deletion workflows remove associated active-system media and records as described in the Privacy Policy.

Partners, gym representatives, and referrals

The Partner Terms of Service apply to coach and influencer applications and participation. The Gym Terms of Service apply to ownership claims and authorized management of a gym presence on LiFit. These supplements apply only to the relevant activities; ordinary members remain subject to these general Terms.

Submitting an application, joining a gym community, receiving a badge, or sharing a referral link does not by itself establish ownership, a professional credential, employment, eligibility for compensation, or a guaranteed payment. LiFit approval concerns access to LiFit features, not certification of a coach's qualifications or a gym's safety.

A coach's external website or service is operated independently. Review the provider's qualifications, terms, privacy practices, and payment or cancellation rules before proceeding. LiFit does not deliver or guarantee coaching purchased on an external site.

Any reward requires an applicable enabled program, eligible participation, and verified activity under the terms disclosed for that program. Referral tracking may be incomplete because of missing link information, device or browser changes, privacy choices, or unsupported installation flows. Do not create false accounts, manufacture activity, or manipulate attribution.

Acceptable use

You may use LiFit only for lawful, personal or otherwise authorized purposes. You agree not to:

Harass, threaten, exploit, impersonate, stalk, or harm another person.
Post unlawful, hateful, sexually exploitative, fraudulent, deceptive, defamatory, or privacy-invasive content.
Promote eating disorders, dangerous challenges, self-harm, unlawful drugs, or unsafe conduct.
Infringe intellectual-property, privacy, publicity, or other rights.
Send spam, scams, malware, unauthorized advertising, or automated messages.
Attempt to access another account, private record, or nonpublic system without authorization.
Scrape, crawl, reverse engineer, disrupt, overload, bypass security, or use bots except where law expressly permits and cannot be waived.
Manipulate likes, reports, leaderboards, achievements, gym membership, or other service metrics.
Use LiFit to provide regulated medical services or represent LiFit-generated information as a medical diagnosis.

Reporting and moderation

The app allows users to report posts and block users. Some reports may trigger automated restrictions or removal; an automated action is not a final determination that someone violated these Terms. LiFit may review, restrict, preserve, or remove content and may limit accounts when reasonably necessary to operate the service, enforce these Terms, respond to reports, comply with law, or protect users or others.

LiFit does not promise to monitor all content or resolve every dispute. If you believe a moderation or account decision is mistaken, contact support@lifit.app with the relevant account or content reference. We may request information to review the issue and will provide any notice or review required by applicable law.

Suspension and termination

You may stop using LiFit at any time and may initiate account deletion in the app. LiFit may suspend or terminate access, remove content, or limit features if we reasonably believe you violated these Terms, created risk or legal exposure, harmed the service or another person, or if the service is discontinued.

Successful account deletion removes supported account records and associated media from active systems. Limited records remain subject to the category-specific retention schedules described in the Privacy Policy; copies someone saved outside LiFit cannot be recalled. Terms that by their nature should survive termination—including ownership, licenses needed for retained copies, disclaimers, liability provisions, and dispute provisions—will survive.

Third-party services

LiFit relies on third-party services including Firebase, Firebase Analytics, Google Sign-In, Sign in with Apple, conditionally configured Google Places requests, USDA FoodData Central food search through Firebase, Google Mobile Ads and User Messaging Platform, RevenueCat, device notification services, app stores, and operating-system sharing and media tools. Third-party services have their own terms and privacy practices, and LiFit is not responsible for services it does not control.

Links, gym information, foods, ratings, or other third-party material are provided for convenience and may be unavailable, incomplete, or inaccurate. Your wireless carrier or internet provider may charge for data use.

Apple App Store terms

If you download LiFit from Apple's App Store, you acknowledge that these Terms are between you and LiFit, not Apple; LiFit, not Apple, is responsible for the app and its content, maintenance, support, and claims relating to the app; Apple has no obligation to provide support; and Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the licensed app.

Your license is limited to using LiFit on Apple-branded products that you own or control as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume-purchase rules. If a warranty required by law applies and LiFit fails to conform, you may notify Apple for any remedy Apple is required to provide; Apple has no other warranty obligation to the extent permitted by law.

LiFit, not Apple, is responsible for addressing product-liability, legal or regulatory, consumer-protection, privacy, and intellectual-property claims concerning the app. If a third party claims that the app infringes intellectual-property rights, LiFit, not Apple, is responsible for investigating, defending, settling, and discharging that claim.

LiFit Pro and future paid services

LiFit provides a LiFit Pro purchase, restore, and entitlement flow through RevenueCat where a supported subscription is offered. Availability depends on your platform, region, and app version. Apple App Store or Google Play processes the purchase and manages the store billing agreement; RevenueCat provides product, purchase, restore, and entitlement status to LiFit.

The purchase screen provides the price, billing period, and renewal and cancellation information before purchase. A subscription renews under the terms shown by the store unless canceled in accordance with those terms; any trial or promotional offer is governed by the terms presented with that offer. Manage or cancel an active subscription through the store account that purchased it. Deleting a LiFit account does not itself cancel an Apple App Store or Google Play subscription. Store-specific cancellation and refund rules apply.

LiFit does not currently provide a native coaching or product marketplace, connected-hardware checkout, automatic partner payouts, or partner withdrawals. A separate, expressly enabled partner program may use verified rewards and manual external payments under its applicable terms. Future feature code or marketing plans do not make those services available.

LiFit intellectual property

LiFit and its licensors retain all rights in the service other than your User Content, including software, interfaces, designs, text, graphics, trademarks, logos, compilations, and other materials. Subject to these Terms, LiFit gives you a limited, revocable, non-exclusive, non-transferable license to use the service for its intended purpose.

No rights are granted by implication. You may not use LiFit's name, marks, or branding in a way that suggests endorsement or affiliation without written permission.

Feedback

If you voluntarily provide ideas or feedback about LiFit, you permit us to use them without restriction or compensation, provided we do not identify you publicly as the source without permission. Do not submit confidential information through feedback channels.

Service availability and changes

We may add, modify, suspend, or discontinue features. LiFit may be interrupted by maintenance, provider outages, device limitations, security incidents, or events outside our control. We do not promise that every feature will always be available, error-free, or compatible with every device.

Features described as planned, in development, or coming later are not commitments to release them or to meet a particular date.

Disclaimers

To the extent permitted by applicable law, LiFit is provided “as is” and “as available.” LiFit disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

We do not guarantee fitness, strength, nutrition, body-composition, weight-loss, social, coaching, medical, or other results. We do not verify every user, post, gym, exercise, food entry, calculation, or third-party data source.

Limitation of liability

To the extent permitted by applicable law, LiFit and its officers, members, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or business interruption arising from or related to the service.

To the extent permitted by applicable law, LiFit's total aggregate liability arising from or relating to the service or these Terms will not exceed the greater of (a) the amount you paid directly to LiFit during the 12 months before the event giving rise to the claim or (b) 100 U.S. dollars.

These exclusions and limitations do not apply to LiFit's fraud, intentional misconduct, or gross negligence, or to death, personal injury, statutory consumer rights, privacy or security obligations, or any other liability to the extent it cannot lawfully be excluded or limited. Some jurisdictions do not permit particular exclusions or limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless LiFit from third-party claims, damages, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim was caused by LiFit's own unlawful conduct, and it is subject to rights that cannot be waived under local law.

Legal compliance

You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government list of prohibited or restricted parties. You must comply with applicable export, sanctions, and local laws when using the service.

Governing law and disputes

These Terms and disputes arising from or relating to LiFit are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, except to the extent the law where you live gives you consumer rights that cannot be waived by contract.

You and LiFit may bring claims in the state or federal courts having jurisdiction over Pearl River County, Mississippi. This venue provision does not prevent you from bringing an eligible claim in small-claims court or in another court when applicable consumer law gives you that right.

These Terms do not require mandatory arbitration and do not include a class-action waiver. Each party retains any procedural rights available under applicable law.

Changes to these Terms

We may update these Terms to reflect service, business, or legal changes. We will post the revised Terms with an updated date and provide any additional notice required by applicable law. If you do not agree to revised Terms, you should stop using the service and may delete your account.
